Terms and Conditions

The legally binding version of these terms is the German AGB. This English version is provided for your convenience.
§ 1 Scope, provider
(1) For the business relationship between KUUDU GbR (Henning Lüke & Dominik Siemon, Röhrenstraße 5, 14480 Potsdam, Germany, referred to as "KUUDU" or "we") and the customer ("you"), the following terms and conditions apply exclusively in the version valid at the time of the order.
(2) You are a consumer within the meaning of § 13 of the German Civil Code (BGB) if the purpose of the ordered products cannot predominantly be attributed to your commercial or self-employed professional activity. An entrepreneur within the meaning of § 14 BGB is any natural or legal person or legal partnership who, when concluding the contract, acts in the exercise of their commercial or self-employed professional activity.
(3) Deviating, conflicting or supplementary terms and conditions of the customer only become part of the contract if and to the extent we have expressly agreed to their validity in writing.
§ 2 Conclusion of contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to order.
(2) By clicking the "Order with obligation to pay" button (or comparable button at checkout), you make a binding offer to conclude a purchase contract.
(3) The acknowledgement of receipt of the order is sent together with the acceptance of the order immediately after submission by automated email. The purchase contract is concluded with this confirmation email.
(4) The contract text is stored by us. You receive the order data and our terms by email. You can access the terms at any time at kuudu.de/agb. You can view your past orders in your customer account.
(5) The contract language is German. Translations, where available, are provided for information purposes only. In the event of discrepancies, the German version prevails.
§ 3 Configured products
(1) Through our configurator you assemble furniture from prefabricated components that we keep in stock (boards, sections, feet, depth variants). The end product is not made to order. You combine standardised parts from our range.
(2) Right of withdrawal: Because configured products consist of standardised stock components and therefore do not constitute goods made to customer specifications within the meaning of § 312g (2) No. 1 BGB, the full 14-day right of withdrawal applies to configured orders as well. See Withdrawal Policy for details.
§ 4 Prices, shipping costs, payment
(1) All prices are in Euro including statutory VAT plus any shipping costs.
(2) Within Germany and the EU we offer free shipping unless otherwise indicated on the product or shipping page. Shipping to third countries may incur additional shipping, customs and import costs, which you as the recipient bear.
(3) Available payment methods at checkout, depending on region:
- Credit card (Visa, Mastercard, American Express) via Shopify Payments
- PayPal
- Klarna (invoice, instalments, instant), where offered
- SOFORT / bank transfer
- Apple Pay / Google Pay
- additional methods shown at checkout
(4) The purchase price is due and payable immediately upon conclusion of the contract. For Klarna invoice, Klarna's separate payment terms apply.
§ 5 Delivery, shipping, lead time
(1) We ship exclusively with DHL, climate-neutral via DHL GoGreen, in plastic-free, paper-based packaging made from recycled materials.
(2) Processing time is typically 1–2 business days. Subsequent shipping times:
- Germany: 1–3 business days
- other EU countries: 3–5 business days
- worldwide: 5–14 business days
(3) Configured products may have longer manufacturing and shipping times. The expected lead time is shown in the configurator and at checkout.
(4) If an item is unavailable, we will inform you without delay and refund any payments already made.
§ 6 Retention of title
The delivered goods remain our property until the purchase price has been paid in full.
§ 7 Warranty
(1) Statutory warranty rights apply. The warranty period for consumers is two years from delivery of the goods.
(2) Our furniture is made from FSC-certified oak veneer and powder-coated aluminium. Natural material characteristics such as grain, knots, colour nuances and slight dimensional variations (within industry-standard tolerances) are not defects.
(3) We do not provide any further manufacturer's warranty unless expressly stated otherwise in the product description.
(4) In case of a defect, please contact us at info@kuudu.de. We aim to resolve every defect fairly and without bureaucracy.
§ 8 Liability
(1) We have unlimited liability for damages from injury to life, body or health, for intent and gross negligence, for fraudulent concealment of a defect, for the assumption of a guarantee, and in cases of the Product Liability Act.
(2) For slightly negligent breach of essential contractual obligations (cardinal duties), liability is limited to the foreseeable damage typical for the contract.
(3) Otherwise, liability for slightly negligent breaches of duty is excluded.
§ 9 Applicable law, jurisdiction
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in another EU member state, the application of mandatory consumer protection provisions of that member state remains unaffected.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the provider's place of business in Potsdam.
§ 10 Dispute resolution
(1) The EU Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr/.
(2) We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Final provisions
(1) Should individual provisions of these terms be or become invalid, this shall not affect the validity of the remaining provisions.
(2) Changes or additions to these terms require text form.
